Sorry late post. Reading her filing waa mind boggling

She has asked Depp to confirm the accuracy of a multitude of tabloid articles which of course he can’t because he didn’t write them. So this is a big part of her evidence.


She is accusing him of using legal privilege as a sword and the shield. What Depp is filing for is the normal affirmative defenses. Which means he’s reserving these defenses in case he needs them but not that he actually will. Which is whether Adam is an agent or an independent.

The keyword is he has not asserted any of these defenses but it’s the way legal system is he either lists them now or he has to waive them

She’s completely twisting so many things including stating that Depp punched Brooks in the face; I mean it’s ridiculous

Her PR team is so desperate now they have to resort to articles because they ran out of arguments.

Retaliation. No evidence. JD is not backing down. His awards, the opening of IN2 in Europe, the success of Puffins, now the release date 12/15/21 for Minamata. She is seething.

My concern, however, this newest idea that the Sun and not the OpEd made him lose his roles in POTC & FB3. That could present an issue. The Sun's article was based on her claims of DV correct?

Agreed. The defamation is specific to the OpEd. Proving Malice=she knows she was lying. I hope that can then apply to all work irregardless of the UK judgement which was based on her same lies

Quick recap
Amber subpoenaed Adam for a deposition and documents. As Johnny's attorney, Johnny owns the right to privilege. Adam can't turn over anything without Johnny's approval. Approving specific documents is not a waiver of over all privilege with Adam. In Fairfax, at first, Amber lost her motion against Adam to compel him and sanction him for not doing his early deposition. Judge White ruled that he was improperly served (they emailed it to Ben Chew). If Adam was properly served, then he should sit for a deposition.

They reissued the Subpoena Feb 22, 2021 and tried unsuccessfully to serve him at home and at work. He has been out of the country for months during that time. They ultimately mailed the subpoena.

Depp filed in Washington DC (Adam's residence/jurisdiction) to quash the subpoena for improper service. Adam joined in that motion. ultimately the DC judge ruled against Depp/Adam. She also dened a stay in discovery (Adam had to start turning over documents).

Depp team filed to appeal those decisions and the Appeal court denied them based on they would probably not be successful.

Amber then filed a Motion to Compel both Adam and Johnny to turn over documents and set Adam's deposition. She also asked for sanctions. Depp filed, you can't Compel or sanction me as I am not named on the subpoena. However, I do not waive priviledge and must appove all docs

You are welcome. Like, I guess, most of us here, I know the case pretty well but the thing I took away and hadn't considered before is that whatever happens, AH cannot be investigated for filing a false DV report. As Lbock and Jax discussed - she didn't really say anything much to the police, didn't report a DV incident and crucially, didn't make the call.

At some point, I wonder if her friends who really are on the hook for this - might finally tell the truth.

IO can claim he knew no better - he was on the phone.

Josh spoke to the police but again can try to claim he simply was reacting to what he was told. Although he clearly lied about the mess, tidying up etc.

Poor Raquel - no plausible explanation for her testimony and likely she made the call in the first place.
