The Sun case has become quite complicated and then considering the ongoing VA trial with opposing rules and restrictions. Lets see how this plays out in the morning

This is the notice from the UK court site that provides at the end the contact to have your email address listed to receive copies of decisiobs in Depp v NGN. It says the court will be releasing the decision also to Bailii, the free database of legal decisions.

Court Clerk email just advised that the hand-down of the decision is delayed until 10:30am London time. 26 more minutes... :hope:

Decision still not handed down yet, delayed further. But Adam seems to be saying its a go

The judge emails the parties' attorneys before he releases the decision to BAILII or anyone else. Protocol and professional courtesy.

Decision was emailed by the court clerk and should be on Bailii (and in full on Twitter, no doubt). It was a win for JD not having the case dismissed, but not a win in that the judge did not order Heard to disclose any of the things JD's team asked for, such as a better tape of the secret San Franciso mtg in summer 2016 where she begged him to hug her while he was under the TRO (he did not), and such as recordings from Toronto and pictures of stuff she claimed he damaged.

Summary of long document: "Subject to the Claimant giving the undertaking regarding not seeking sanctions against Ms Heard for any breach of the Virginia protective order because of such assistance as she has already or may in the course of this litigation give to the Defendants, I will grant the Claimant relief against sanctions.
I refuse the Claimant’s application for a third-party disclosure order against Ms Heard."

Also, the extremely efficient Court Clerk, Amy Baker, actually took the time to answer my emailed question if the trial would be streamed:

"The trial will take place at the Royal Courts of Justice and therefore cannot be streamed from remote locations.

Spaces for members of the Press are ticketed and for members of the public are offered on a first come, first served basis. Spaces are extremely limited because of the social distancing requirement."

Wish I was in London and able to take the time off work.

It is crazy to me that The Sun relies on everything Amber Heard says and the evidence she is willing to supply, but Johnny cannot force her to provide evidence. Anything he filed in VA including marked confidential is fair game to be turned over and he must promise not to seek sanctions against her for violating the protective order in VA. HOWEVER, Johnny is not allowed to turn over anything from VA that she submits and marks confidential without her explicit permission.

This is a tough case and doesn't appear for those reasons above to be fair. There are 14 separate incident claims and NGN only has to prove one of them for a win. So it not only comes down to evidence and witnesses but also to credibility on the incidents that were 'behind closed doors' and only he said/she said.

Thank goodness. It would have been so disproportionate to strike out the case particularly as this really did look like a mistake and the Sun appears to have been a bit shady in waiting so long to file their complaint. I don't think I could quite have stood the crowing from AH's stans claiming this 'proved' that he was guilty.

Regarding compelling AH to give over her evidence - I don't think it works like that in English cases. JD's side could only ask for things in discovery if the Sun have them.

JD's lawyers know how English law works and I suspect the whole point of the request was to firmly plant the point that JD's side believe she is withholding information from her own allies in this case.

Lbock I think your last para makes a good point. But on those incidents where there were no witnesses and no independent evidence - a key point will be the credibility of the two witnesses ie JD and AH. It is why is it important that JD's side be allowed to submit evidence that she has lied before - and to officials/in legal matters - as this will carry significant weight with he judge. So asking the letter to Homeland security, the emails asking people to lie for her - plus if they do allow the Australian dog evidence - all of that will undermine her credibility as a truthful witness. And that's before you start taking apart her narrative on the incidents where there are witnesses and evidence.

It should also help Johnny that nobody seems to have seen and/or treated any bruising or wounds on AH's person after all that she says she has gone through. In my layman opinion, that is :biggrin:

Here again she can pick and chose what to submit. Did she "call" anyone. but not follow up. Johnny can't get his hands on her medical, or non existence of it, in time to use in the UK courts. And, any medical he gets on her therapy, etc, will all be marked confidential and he cant use those.

Wow! Just saw the announcement on a Toronto, Canada, news channel that the case will go forward. It will be interesting to see how it goes if so much evidence cannot be used. I am glad it was not quashed, though. Claims that someone is violent is rather serious when the source causes many to believe it. Prayers for Johnny!
