What will be interesting though is Heard's reply to Johnny's complaint.
From that we might get a feel of what she intends to do.
Is she going to continue to double down on her lies or add more or pretend she isn't aware of the events, and how she manages to do this in a legal document without perjurying herself further.
Really this case should have been wrapped up a long time ago.
As for the *plea* or whatever it may be called in a civil suit, maybe not *temporary* but *all encompassing* insanity. Hahaha

The Sun has made a truth defence so they have to prove Johnny was a "wife beater".
I don't think their defence is any easier if the wife claims she has been insane at times.
Mental illness seems a poor defence in a defamation case as it would not prove that what was written was true. If claiming temporary insanity when writing the article, then the question is why not retract and apologise when later sane.
Claiming insanity might reduce the malice or the damages but it would show the 'defamer' was unreliable.

I was thinking more on the terms of her finally admitting defeat, confessing, and her reasoning for the crime down to mental illness.
Not adding another layer to the case.

I think if Amber was going to use "mental illness" in any form it would have been brought up a long time ago. She is never going to admit to that but if Waldman gets her medical records and what kind of drugs she was taking that could be a different story. She obviously has some kind of behavior issue but she has been playing people for years now and even Jerry saw right through her and her attempts of manipulation.
As for the answer to Johnny's complaint against her, Kaplan has had more than enough time to prepare a response so there should be no excuse to delay that any further. Kaplan has already lost all the attempts to dismiss in lieu of an answer and right now that team is looking pretty silly and her buddy iO isn't doing her any favors right now either.

She's going to lose it.

5th Amendment, refusing to answer a question because it could cause criminal charges to be brought, or adversely affect me in another criminal investigation or case. Self Incrimination of a crime.
There is no 5th amendment in the UK, so can't claim that for The Sun. Once they agree to be a witness, they must answer questions (as I understand it) They can sit there and be silent, but then guilt will be inferred.
In a civil trial, she can claim the 5th per question and answer other questions. However, in a Criminal trial the jury is NOT allowed to hold that against the witness (assume guilt), but in a Civil Trial, they can infer anything from a witness refusing to answer including "well, if they won't answer, they must be guilty"

Lbock, thank you for that. Interesting. Did I imagine it that AH's lawyer said at the beginning of one segment "we've changed our minds we aren't going to plead the fifth?" I will have to spend the evening OD-ing on Brian's videos to find it. I just wish we could get to court or get it decisively over with in Johnny's favour. I am not sure I can take much more of the twitter rants!

It's really hard to wrap my brain around the fact that they would be so careless, but it's been fun to watch. They're digging themselves such a deep hole and Adam is right there seeing it all.
