I believe you're right, Snoopy-Dances. I think the lawsuit was filed when it was as an effort to stall the foreclosure.

But what a travesty on TMG's part! If you haven't already, you might want to go to shaman-art's link shown above and read part G, pp.19 through 21, paragraphs 72 through 84. Be sure you're sitting down and be ready for sharp intakes of breath. This firm is duplicitous beyond belief - and this is just one of their twisted, underhanded, but extremely slick, maneuvers. Johnny didn't stand a chance unless he'd had independent second and third parties auditing TMG's records (nonexistent, as it turns out) from 1999 - on.

Johnny lost his castle? Someone can clarify it to me, please?
No - this is just a warning that the castle could go into foreclosure. He still has time to make the required payment.
I think the "castle" - JD's primary residence - was going to be foreclosed upon on January 14th, but the filing of the lawsuit at the eleventh hour on the 13th (after the divorce was finalized), may have temporarily stalled TMG's ability to proceed. Timing is everything, eh?

SnoopyDances wrote:Thanks Shaman Art for the document. I browsed through most of it...but the amount lost vs. the amount asked for is curious.
He is only asking for "at least" $25m in damages, yet the suit alleges a much larger amount in losses, loans, properties, and fees.I wonder why he isn't seeking more in damages? You can ask for any amount you want and might get less, but if you ask for less, you rarely get more.

Also, I find it interesting that he is seeking a trial by jury. I wouldn't think he would want a lot of the details made public and the media circus that would surely follow every sordid moment. Of course, trial by jury is often used as a bargaining tool by lawyers to prompt a quicker settlement without going through court or a trial. I'm sure TMG doesn't want a lot of things detailed in a media circus, either. Maybe the plan here is to prompt a quick settlement without acknowledging any wrongdoing by either party.
I was just reading the document, Snoopy. Johnny IS asking for more than the $25 million. If you scroll down to page 42 of the complaint, article 173 (I've taken a snapshot of the article), you'll see he's not only filing for the $25 million, but also for all fees and contingent fees (the 5% of gross earnings that TMG took--some $28 million) AND interest on those fees.

Also in the document, I have seen it referred to in excess of $25 million, and also $25+ million.

Also, on the bottom of page 43 and top of page 44 of the document, you can see exactly what Johnny is asking for, and it is well over $25 million. (See PRAYER FOR RELIEF)

His lawyers could not put a specific monetary value to it because the amount is to be determined according to proof at trial.

Not only that, but from what I can tell from reading the complaint, his new management company is still trying to uncover and unravel the level of fraud and, well, theft...that his former company did.

It's very sad if he should lose the castle - and the island. Hopefully it doesn't come to that. :-/

There are people who have not yet been named that may have been involved in business deals with the former business associates.

It seems strange to me that given that type of business...with that much money on the line....in that town...why would anyone rely on an "oral agreement "? Is this typical in this business? All I can say is that I wish him the best. He deserves some peace.

No, only his main residence (and possibly some of his other houses on the same street)

No names there, but this is not difficult to us imagine. :grr:

Well, given the fact he filed the complaint the same day as the divorce certainly sets up a red flag for me.

I have to agree, Forever Young. Red flag for sure.

On February 20, 2009, a company called "Under the Black Sky, Inc." was registered in CA under the Van Ree surname. In 2015, paper work for the same company was filed in Texas, now as a foreign for-profit corp, keeping the Van Ree surname.

If there is any connection to TMG, hopefully it will be found. Frankly, when you consider the enormous risk JD took by waiting until the divorce was finalized before filing the lawsuit, well, I just don't believe in coincidences . . . .
