Johnny Depp’s Ex-Wife Urges Judge to Toss Defamation Case

One year ago, with the blockbuster “Aquaman” hitting theaters nationwide, the movie’s co-star Amber Heard wrote an editorial describing the backlash she faced as a public figure who spoke out against domestic abuse.

Heard now faces a $50 million defamation lawsuit stemming from the article. Her attorneys argued Friday that she was simply stating her opinions in the op-ed, not directly referring to the ex-husband who brought the case against her: actor Johnny Depp.

Appearing in Fairfax County, Virginia Circuit Court, the attorneys argued that Depp’s lawsuit is an overreach and should be tossed out. While lawyers for the two estranged Hollywood stars routinely square off over various aspects of the case, Heard’s lawyers on Friday asked for an outright dismissal.

Depp, who filed the suit in March, was not specifically mentioned in Heard’s op-ed. But his lawyer, Benjamin Chew of Brown Rudnick, argued that the “Pirates of the Caribbean” star was defamed by implication. The editorial “unmistakenly referred to Mr. Depp,” Chew said.

Depp, 56, and Heard, 33, had a highly publicized and contentious divorce. In 2016, Heard, with bruises on her face, asked a California court for a restraining order against Depp. Their marriage ended in 2017. Heard’s editorial was published Dec. 18, 2018, in The Washington Post.

In court Friday before Chief Circuit Court Judge Bruce White, attorneys for both actors debated the significance of one sentence in the editorial: “Then, two years ago I became a public figure representing domestic abuse and I felt the full force of our culture’s wrath for women who speak out.”

Chew argued Heard was referring to “the precise time frame when Ms. Heard publicly and falsely accused Mr. Depp” of domestic violence.

But Heard’s assertion was simply a statement of fact, argued one of her attorneys, Benjamin Rottenborn of Woods Rogers. At most, he said, the op-ed may have reminded readers of the restraining order.

In legal filings, Rottenborn also wrote that taken to a logical end, Depp’s arguments in the case demand that “Ms. Heard be silent or else be punished in perpetuity for her decision to seek the protection of California courts in May 2016.”

Judge White has already denied a previous attempt by Heard’s lawyers to toss the case out.

On that occasion, her attorneys argued that the case didn’t belong in Fairfax County, where The Washington Post is printed, but instead should be in California, where the parties and potential witnesses reside.

On the bench Friday, White said he would consider the arguments and rule at an unspecified date.

And no, Ms Heard didn't mention Johnny. But how many men besides Johnny has she accused of abusing her :facepalm: ?

Debating the significance of one sentence: " then 2 years ago . . . . " Really? Team Heard is trying to convince the court that it's just an odd coincidence that this was the same time frame in which she declared that JD abused her. There is no question that the op-ed that was written in the Washington Post on December 21st 2018 is directly aimed at JD. If I remember correctly did she not try to get this publicized in California and was refused.. Then she used her contacts at the ACLU to have it published in the Washington Post out of New York? Let us not forget the interview that she did overseas, talking about victims of domestic violence with JD's picture in the background. How in the world is Kaplan going to justify that? According to sources Kaplan was not in the courtroom today. Reason being, she is getting ready for a new case against the president of the United States, Donald Trump.

Amber Heard's parents tried to tell Johnny Depp that the restraining order filed by their famous daughter after the fight between the two stars was not something she did "willingly or happily," and even said to him "I love you, son."

The Blast obtained new text messages between the "Pirates of the Caribbean" star and the "Aquaman" star's parents, David and Paige. The messages are now evidence in the ongoing legal battle between Depp and Heard and show that both of her parents claimed it was the lawyers who deemed it necessary to file the legal documents. In one message, Paige Heard attempts to explain to Depp that it was her daughter's only choice to get protection from being evicted from the couple's luxury apartment after the fight.

Mrs Heard: "She DID NOT Want To Do This"

As we reported, both Heard's parents were texting with Johnny Depp on May 27, 2016, in the hours following the star filing for a restraining order and including photos of her face in what she claimed were injuries inflicted by her then-husband.

At 7:59 PM Paige Heard sent Depp the following text:

"It's the lawyers on both sides doing this not Amber. I heard the whole story very teary - if I could just talk to Johnny. She didn't want this. Friggin lawyers on BOTH sides!! This was not her idea, not her wishes. She was told she would be evicted and out in 30days if she did not do this."

At 8:03 PM, she continued:

"Her dumb lawyer possibly as the only way she would have a place to live in 30 days. She DID NOT want to do this I swear to you. The lawyers are frigging things up."

Depp responded to his then-wife's mother that the injury photos were doctored, and claimed to be in shock that she had portrayed him in court as a violent wife-beater.

Depp Says "I Do Not Deserve This"

At 8:40 PM Depp responded to Paige Heard:

"if she didn’t want to file a restraining order against me and send a message to the world that i am some kind of violent wife beater ...then why would she go to the courthouse with a photo of her that looks like she’s been abused??? this is my life too, what are my children and my children’s friends supposed to think??? I do not deserve this, and they do not deserve this... especially not from her."

As they continued their conversation, Heard's mother reiterated she filed the case ONLY because she was told it was the only way she wouldn't get kicked out of the apartment. She also was adamant that her daughter did not file it willingly.

At 8:47 PM Paige Heard texted Depp:

Her lawyer told her she had to and she had to today. That's why she wanted to talk to you. We didn't talk so please never bring this up. But I'll swear to you this was not her idea nor did she do it willingly or happily. She was told it was her ONLY option to not being kicked out. I'm not making excuses but that is what she believed. She did not want to do it. She felt she was betraying her only love but the lawyers said so."

Shockingly, after hearing the details of the alleged altercation between her daughter and Depp, Heard's mother ended the message exchange by telling him, "Please don't pass this on if you ever talk to Amber again. I love you, son."

As we first reported, the same night Depp was also texting with Amber's father David Heard, and he agreed with his wife about the reason for the going public with a restraining order and abuse allegations.

Mr. Heard: "She Would Have No Place To Live"

In a text message, Johnny Depp texted Mr. Heard enraged at the allegations he had just been accused of, saying, "Amber is calling this domestic violence!!! she submits a picture that says i threw the phone at her!!! she is putting herself in deep trouble if she continues to perjure herself... I have done nothing to deserve this!!! this is so f***ing sick."

He continued, "i have 2 witnesses who were in the room when she said that i flung the phone at her. ABSOLUTE F***ING LIE!!! she wants a divorce, she get’s it. but the world will receive the truth and if she is caught perjuring herself (which she will)."

David Heard responded to Johnny Depp at 7:53 PM:

The lawyer told her she had to or she would have no place to live in 30 days."

Johnny Depp responded to David Heard at 7:59 PM:

that is absolute bulls***!!! HER LAWYER ASKED FOR TWO WEEKS at the downtown place... AND I SAID, “NO”!!! SHE COULD STAY THERE AS LONG AS SHE LIKED!!! WHY WOULD I FORCE HER OUT IN 2 WEEKS??? I AIN’T NO SCUMBAG!!!"

Johnny Depp went on to tell Amber's dad he was still wearing his wedding ring and was still in love with Heard.

Depp continued:

"dude, my f***ing wedding ring is still on me!!! i has not taken it off, because i love her... it is coming off now. what a f***ing knife to the back, i’m so disappointed and so hurt... it’s just too much... x... later, brother...feel better!!! Jd"

The text messages have become an important part of the ongoing legal battles between the ex-couple after Johnny Depp filed a lawsuit for defamation against Amber claiming the allegations are a "hoax." Depp's legal team believes part of her motive was financial.

Amber's Lawyer: Texts Don't Exonerate Mr. Depp

In response to the text messages, Amber's lawyer Roberta Kaplan told The Blast, “Less than a week ago, the Court made clear its concern about the parties trying to litigate this case in the press. Given those concerns, we are astonished that Mr. Depp’s lawyers once again leaked documents to The Blast involving Ms. Heard’s elderly parents that Mr. Depp’s lawyers claim somehow exonerate Mr. Depp, particularly when they have not even been produced to us in discovery. Mindful of the Court’s comments, we look forward to litigating (and winning) this case with admissible evidence and sworn testimony in court, not in the media.”

The defamation case has a hearing today, to hear Amber's motion to dismiss the case. If it is not dismissed, the case will go to trial later this year.

Exactly, meeps. Was there someone else she filed for a TRO against in 2016? And, of course, if this TRO accusation was a lie (not a stretch given the LAPD officers’ depositions) then the whole OpEd was based on a lie, and Johnny was certainly the victim of defamation. Her OpEd in the Washington Post (as opposed to a two-bit tabloid) was the media version of the proverbial shot heard round the world.

I want to think positive and trust that after today’s arguments, the Court is comfortable with the possibility the OpEd was based on a lie by the Defendant, leaving Judge White to ultimately overrule AH’s Demurrer and deny her Plea in Bar. Perhaps the Judge felt he needed to have a justified, written statement accompanying his decision, rather than a simple verbal ruling from the bench, thus the wait.

Does anyone know if the newest developments of the text messages from AH's mother was told to the judge? That would definitely show that this was all based on a lie.

As far as I can discern they were submitted as evidence. Judge wouldn’t see them as yet officially unless Depp team submitted them as part of their motion or hearing. Which may be how Blast got them 🤷🏻‍♀️

Going back to yesterday, this puzzled me as well, Forever Young, because I understood that the bday party was at their condo (he arrived late and brought new financial advisor Edward White with him). They went to bed after the guests left, she started berating and hitting him, he left, she threw his wallet & phone over the balcony, and she drove to Coachella the next day with her buddies after leaving feces in the bed. And yes, I remember that he said that's when he decided it was over between them.

As far as her parents' texts that the dv claim was all "the dumb lawyer's" idea, what if Amber lied to her parents? After all, we know now that she was involved with Musk, was shown laughing in the elevator, and was photographed laughing with Pennington on May 28th. She clearly was not upset about filing for the TRO and hurting JD's reputation. The May 28th picture, particularly, made me think this was all a scam. Also, per the article below from May 2016, Johnny was sending these texts from the Vampires' European tour, where he was later photographed with Tim Burton & Alice Cooper in front of Dracula's Transylvanian castle. The last 2 sentences of this article below may be the official start of the campaign to portray Amber Heard as a "hero" representing female victims of domestic violence, stemming directly from her allegations that Johnny Depp physically and mentally abused her for the duration of their relationship. Also, she need not have gone to those lengths to get a TRO to remain in the condos. I call BS.

Amber Heard Suffered 'Years' of Abuse by Johnny Depp, Lawyers Say

Actress Amber Heard didn't initially report the domestic abuse she claims husband Johnny Depp inflicted on her this month "in an attempt to protect her privacy and (his) career," her lawyers said Tuesday.

But Heard, 30, has since given Los Angeles police a statement about the alleged incident in order to combat the "false and malicious allegations that have infected the media," attorneys Samantha Spector and co-counsel Joseph Koenig wrote in a letter provided to NBC News.

"Amber has suffered through years of physical and psychological abuse at the hands of Johnny," Heard's legal team said.

Heard, who co-starred with Depp in 2011's "The Rum Diary," revealed the Hollywood power couple's allegedly tumultuous relationship in a shocking court filing last week.

She cited irreconcilable differences after 15 months of marriage and obtained an order of protection from the 52-year-old Oscar-nominated actor after she claimed the domestic violence culminated on May 21 — when he struck her in the face with a cellphone.

Heard reportedly began living with Depp in 2012 and they married in February 2015 with a celebration at his private island in the Bahamas.

Attorneys for Heard say police were called to the couple's downtown Los Angeles penthouse by a third party after the two began fighting and Depp allegedly threw a phone at her face.

Heard in a sworn declaration last week said that Depp was high and drunk, and that she lived "in fear that Johnny will return to (our house) unannounced to terrorize me, physically and emotionally."

An LAPD spokesperson told NBC News on Friday that no one wanted to press charges when officers arrived, and that they saw no visible injuries so ultimately decided against a criminal investigation.

Two days after the alleged incident, Heard's attorneys filed the divorce petition, but said Depp was not served that same day because it was the Hollywood premiere of his latest movie, "Alice Through the Looking Glass" — and insisted she didn't want the marital abuse troubles to be made public.

"We sent a letter to Johnny's counsel team the next morning making it clear we wanted to keep this matter out of the media," the attorneys wrote. "We then held off requesting a domestic violence restraining order as we knew that Johnny was out of the country."

Depp had been promoting the "Alice" sequel, in which he plays the Mad Hatter, and also performed in Lisbon, Portugal, on Friday night with his rock band, the Hollywood Vampires.

But after Heard's name was wrongly vilified, Heard's attorneys say, they hope police will open an investigation based on her latest statement to the LAPD.

"If that occurs, and the truth is revealed, there is no doubt that Amber’s claims will be substantiated beyond any doubt, and hopefully Johnny will get the help that he so desperately needs," the attorneys said.

Depp's attorney, Laura Wasser, declined to comment about the Hollywood breakup when contacted by NBC News last week. A spokeswoman for Depp did not immediately respond to an email seeking comment Tuesday.

The "Pirates of the Caribbean" star has not publicly commented either since the allegations surfaced last week, and a rep told E! News that he will "not respond to any of the salacious false stories, gossip, misinformation and lies about his personal life."

Depp's friend, comedian Doug Stanhope, wrote Sunday in a guest column on TheWrap.com that Heard was the one who manipulated Depp, and that she was essentially blackmailing him as part of their divorce: "Amber was now going to leave him, threatening to lie about him publicly in any and every possible duplicitous way if he didn’t agree to her terms."

Heard's attorneys on Tuesday didn't cite the column specifically, but said her character is being maligned and she is standing up to "Johnny's relentless army of lawyers and surrogates."

"Amber is simply a victim of domestic violence, and none of her actions are motivated by money," they said.

"The Family Law Court is not going to be influenced by misinformation placed in the social media based on anonymous sources," they added. "Amber is the victim. Amber is a hero."

That's the first time I've heard that.
And - if she really did, wouldn't the LAPD have started investigating already back then? Or is a statement not the same as reporting a crime to the police ... I am not American, and English is my second language, so I apologise, if my questions sounds stupid, but I don't understand that bit :blush:

It was yet another lie to make herself look better in the media. She never gave a statement or anything after filing for the temporary restraining order.

But that should have been clear to the journalists back then, shouldn't it? If they had thought about it.
The police didn't start an investigation of Johnny - at least we never heard, they did. And I am sure, the tabloids would have loved to be able to say, that the 'bad boy' Johnny Depp was being investigated for spouse abuse. But they didn't crow that at any point, as far as I know.
So the media should have known already at that time, that she lied about having gone to the police to clear her reputation. Trying a she-was-not-a-gold-digger-or-pretty-hard-hearted-woman-because-he-had-abused-her-first type of thing.
Plus the old article also claims, that Ms Heard and her lawyers back then waited with the restraining order, because Johnny was out of the country by then. Only in the next sentence to say, that he was in Portugal playing with the Vampires on Friday, when she went to court. He might even literally have been on stage at the time she ran the show for the journalist in the court room in Los Angeles due to the time difference.
So again - does journalists not think before publishing something? Or did they just see Young, Blond, Sexy, Girl/woman, Scandal, Older Man, Former Bad Boy, and ran the story on those "hash tags" ...
