I am not sure if the Anti Slapp legislation would apply to this case, even if it is voted into law in VA. The case was filed before the legislation existed. I do not think that the law can be applied retroactively. This would be decided by a judge. I think this case has an excellent judge. He is not swayed by Amber Heard's nonsense. Amber and her attorney's are putting all of their efforts into getting the case thrown out. They are faced with the overwhelming evidence that Amber Heard is an abuser and a liar. They are desperate to get this case thrown out. It is hilarious that Roberta Kaplan keeps insisting that they want the truth to come out but she keeps trying to get the case dismissed. She must be as arrogant as Amber Heard if she thinks that people can not see right though her phony tactics.

They were asking for legal fees too for the demurrer/plea in bar

I’m disappointed the judge didn’t award any to Johnny

I was wondering the same. Judge White’s Opinion Letter doesn’t mention the request for legal fees much less a ruling on the request.

I think Judymac’s question is a fair one. Further, at this point, the Defense’s propensity for filing frivolous and/or repetitive motions (together with seemingly bottomless pockets) are posing the potential to undermine any hope for justice triumphing in this case.

My only thought is that, perhaps, Judge White is waiting to see if Defense is going to respond yet again with another delay, related to his Opinion Letter, and then in a final ruling on the topic include a response to Plaintiff’s fee request. Only the Court can put a stop to the Defense’s gratuitous wheel-spinning. Awarding legal fees to the Plaintiff at such a significant juncture might do just that as well as send a message as to what will/will not be tolerated going forward through major discovery and the trial.

In any event, until Judge White specifically addresses a fee request, the potential for such an award lies open.

I think maybe the judge is waiting for the final ruling on the entire case to decide if Johnny should get rewarded his legal fees. He isn't going to get anywhere near $50 mil because she doesn't have that kind of money. She is not working on any films and has no contracts to work that I know of for the future where he could put a lean on future earnings. The projects she has right now is probably the only thing paying her bills and I don't think his intention is leaving her out in the street, despite what she has done to him. Based on the comments I have read recently, there is a big turn around with people now who were on the fence and she isn't getting much support at all. I don't think I have ever seen so much support for him on DM during this whole four year mess and with her getting exposed with these recordings I doubt she has any future in Hollywood left. No..she is going to learn the hard way about about keeping her big mouth shut.

Agreed. JD will never see that kind of money from her. Liens, possibly.

JD wants his name cleared. Understood.

Heard and Co., need to be made EXAMPLES. Society needs to make, Heard understand that she is NOT ABOVE THE LAW.

She has done so much damage to those: men, women, elderly, and our children (bullying), who have been abused, who will not come forward. Heard has pushed victims and survivors back into the stone age.

I hope that the media who has sided with her, and those companies that sponsor her, get a VERY RUDE AWAKENING, quickly.

It's not coming fast enough.

In those recordings Johnny made it quite clear he didn't want anything from her except a quiet divorce. He said that he didn't want to smear her name or anything ..he wanted absolutely nothing but to settle things quietly and peacefully but she refused. Still, after everything she did to him, he has too much class to take every cent she has and leave her homeless, imo, BUT her being exiled from Hollywood because she chose to be stubborn works for me. :pirategunshot:

Yes, Johnny did give her the opportunity to end their marriage peacefully but she refused. What is interesting to me is how it was so important for her to save her reputation and name. (something Johnny has been fighting for all this time) Johnny replies, "it's too late."
Or words to that affect. He understood the power of the media and was giving AH advice that the only way she'd get out of all of this with some dignity is to quietly divorce. She didn't listen and chaos followed. It's self sabotage.

Remember too. Their July meeting Carino helped to arrange. The breakdown of the initial settlement was that Johnny would never agree to any statement of abuse on his part which matches his texts. (Mutual stay away with 50k per month for 6 months?) The next day she’s papped at Elon’s hotel bungalow in Miami and then the nightclub with him in London. Which put him over the edge and realized again she just played him repeatedly. That’s what precipitated his “hey I met someone” et al vitriolic texts . I’m just so sad for him. He thought she wanted to clear the air. Just love bombed him to coerce him again. :)

I agree she should be kicked to the curb and left with nothing but Johnny is a good man who is only trying to save his reputation. Amber had no reputation left to save but she was too ignorant to realize that even when he tried to reason with her so let her go down in flames. She pooped in the bed and now she has to lie in it.

I'm thinking of Adam Waldman's statement a while back that Johnny's case vs. Heard (the Virginia one if I recall correctly) was "the tip of a defamation iceberg."

I interpreted that as meaning that, if JD were to win, a domino effect would be created whereby he could successfully sue Heard's media partners in crime, such as People and the Washington comPost. It's crucial, then, that JD not settle his cases against The Sun-Wooten and/or Heard in VA. He needs an official judgment in his favor to clear his name publicly and to base the domino effect cases on. Any settlements would be confidential and wouldn't clear his name in many minds.

Winning the case against The Sun and being awarded punitive damages and any cases vs. People and other publications and guilty contributors is where the big money is.

JD is a good man, but what Heard did to him, his career and his children, while still posting pictures flaunting the Mustang and other things of his she wrongfully took is beyond the pale. I don't think he has any compassion left for her, nor should he. He should get money from her, esp the $7 mil divorce settlement as poetic justice. And, if the divorce proceedings reveal she forged documents and lied to the U.S. and Australian governments, she should face the ugly consequences of those deliberate acts as any noncelebrity would. If that involves jail time, I'm all for someone posting a poll where we could select Amber's prison jumpsuit from the various styles available.

And I hope to see Ion Toilet and anyone else who lied to authorities or defamed him face public consequences, as well.

Yes, I’d forgotten about Mr. Waldman’s “....tip of a defamation iceberg” comment. I think your interpretation is right on the money, Ruby Begonia (forgive the pun, please).

I also agree with each and every point of wish-list justice you’ve made for Johnny: well thought out, practical, and deserved. The only one I fear may never come to fruition is the very one I feel is most warranted and what I, personally, most want to see realized: AH in a prison jumpsuit, for a very long time.

Adam also said he didn't want WaPo, etc coming in as a friend of the court because it is possible they may also be brought into the suit.

But, keep in mind, most Defamation laws have a one year time limit. So I don't think we will be seeing any more lawsuits from Johnny. Not to mention, he is ready to move on with all that he has had to deal with in the courts and legal fees.

I am also not counting on the VA case happening in August. With the demurrer pending, I doubt they've done many if any depositions. We certainly haven't heard of any. Now with the virus, not sure when they will be completed. With her 40+ subpoenas for documents and any of Johnny's, we will be seeing a mass of Limine Motions (rulling on admissibility of evidence from all that discovery) close to trial date. The Rocky case only had 6 limines, and the 6th one caused the trial to be delayed 7 months.
(Kaplan said "the courts have strong mechanisms in place for determining the truth" and I think this is what she was referring to-keeping out as much evidence/declarations etc that Johnny brings as possible)

I am so glad this case can move forward and will be so happy when Johnny clears his name, but The Sun case, IMO, has the best chance of completing this year.
